Colorado laws and regulations for independent living communities

Colorado doesn’t have specific laws or regulations for independent living, because these communities don’t provide personal care or medical care services like you may find in an assisted living or skilled nursing facility. Stand-alone independent living communities

Stand-alone independent living communities in Colorado must follow the state’s rental laws, which are outlined as landlord and tenant rights respectively. The following list provides examples of laws that protect tenants in Colorado:[02]

  • Properties for rent must be habitable, and the landlord is responsible for ensuring the property is maintained.
  • Property owners must respond to requests and provide necessary repairs to the property in a timely manner.
  • Property owners must disclose certain information to tenants before they sign the lease agreement. This may include information on things like utilities, radon detection, bed bugs, or lead paint.
  • Property owners must return security deposit to tenants within one month of the lease termination, unless otherwise stated. Security deposits cannot be used to cover normal wear and tear.
  • Property owners cannot discriminate against renters based on citizenship status, race, color, religion, national origin, sex, disability, or familial status.

It’s important to note that local governments, such as city or county governments, may have additional regulations guiding the protection of tenant rights. Our Denver Independent Living page provides examples of rental laws that are specific to an individual city.

Most independent living communities have an age minimum. Some communities accept residents 55 and older, and others require residents to be at least 62. The age requirement is usually posted on an independent living community’s website.
